1. Acceptance of Terms
By accessing or using The Pro2col ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please discontinue use of the Service.
2. Use of the Service
You agree not to:
- Interfere with or disrupt the Service
- Attempt unauthorized access to systems or data
- Use the Service for illegal, harmful, or fraudulent activity
- Reverse-engineer, decompile, or modify any part of the Service
3. Accounts
To use certain features, you may need an account. You agree to:
- Provide accurate and complete information
- Protect your password and login details
- Accept responsibility for all activity under your account
We may suspend or terminate accounts for violating these Terms.
4. Payments (If Applicable)
If The Pro2col offers paid features:
- Prices are displayed at the time of purchase
- Payments must be made through approved third-party processors
- Refund policies will be provided separately
4.1 SMS/Text Messaging Terms
By explicitly opting in via the consent checkbox on our website forms or during the booking process, you consent to receive automated text messages from The Pro2col. These messages may include appointment confirmations, reminders, pre- and post-care instructions, follow-ups, and promotional offers related to our services. Consent to receive text messages is not a condition of purchasing any service. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact us at connect@thepro2col.com. Carriers are not liable for delayed or undelivered messages.
5. Intellectual Property
All software, content, designs, trademarks, and materials on The Pro2col are owned by or licensed to us. You may not:
- Copy or redistribute content
- Create derivative works
- Use our intellectual property without written permission
6. Termination
We may suspend or terminate access for:
- Violations of these Terms
- Illegal activity
- Security or system risks
You may stop using the Service at any time.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available." We do not guarantee:
- Uninterrupted service
- Error-free functionality
- Accuracy or completeness
Use is at your own risk.
8. Limitation of Liability
To the fullest extent permitted by law, The Pro2col is not liable for:
- Indirect, incidental, or consequential damages
- Data loss
- Service interruptions
9. Indemnification
You agree to indemnify and hold The Pro2col harmless from claims arising out of:
- Your use of the Service
- Your violation of these Terms
- Your infringement of any third-party rights
10. Changes to These Terms
We may modify these Terms at any time. Continued use of the Service means you accept the updated version.
10.1 Mobile App Terms
The PRO2COL mobile app is a members-only companion experience for active PRO2COL members. The app may allow members to view protocol information, session information, educational content, Reflections, account information, and other member-specific features.
Member-only access
Access to the mobile app may require an active PRO2COL membership and staff-provisioned or staff-invited account access. The public website does not include a PRO2COL member portal in v1.
Account responsibility
Members are responsible for maintaining the confidentiality of their app login credentials and for notifying The PRO2COL if they believe their account has been accessed without authorization.
No medical advice through the app
The app is intended as a companion tool for members of The PRO2COL. The app does not provide medical advice, diagnosis, or treatment. Information displayed in the app may reflect member protocols, sessions, educational content, or information provided by The PRO2COL team, but members should always consult their PRO2COL care team or a qualified medical professional before making health decisions.
Emergency care
The app is not intended for emergencies. If you are experiencing a medical emergency, call 911 or seek immediate medical attention.
Booking and practice-management
The PRO2COL uses Pabau as its booking and practice-management provider. Some appointment, package, document, consent, or practice-management functions may be powered by Pabau or may link to Pabau-supported experiences.
Some booking, intake, form, consent, document, or practice-management actions may open through Pabau-hosted pages or links. These experiences may appear outside of The PRO2COL website or mobile app but are used to support The PRO2COL's booking and practice-management workflows.
Membership and payments
The mobile app does not create a separate membership purchase agreement. PRO2COL memberships and facility services are purchased or managed outside the app, through The PRO2COL's approved business processes and providers. Deleting the app account does not automatically cancel a membership.
Account deletion
Members may request deletion of their mobile app account through the app or by visiting /account-deletion. Some records may be retained where legally, clinically, operationally, or financially required.
App availability
The PRO2COL may update, modify, suspend, or discontinue parts of the mobile app. Some features may require a current app version, active membership, internet connection, or third-party provider availability.
Apple and Google
If you download the app through the Apple App Store or Google Play, your use of the app may also be subject to the applicable platform terms and policies.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, USA, without regard to conflict-of-law principles. Any disputes arising from or relating to these Terms or your use of the Service will be resolved in the courts located in Davidson County, Tennessee.
